Filing a Workplace Discrimination Claim
Steps to report and file claims for workplace discrimination
Step-by-Step Instructions
Document the Discrimination
Keep detailed records: dates, times, witnesses, what was said/done, and how it affected you. Save emails, texts, and any written evidence.
Report Internally First
Follow your company's complaint procedure. Report to HR or your supervisor (unless they're the problem). Document all internal complaints.
File EEOC Charge
File a charge with the Equal Employment Opportunity Commission within 180 days (300 days in some states) of the discrimination. Can be done online.
EEOC Investigation
The EEOC will investigate your claim. They may request documents from your employer and interview witnesses. This can take months.
Mediation Option
The EEOC may offer mediation to resolve the dispute. Participation is voluntary and can lead to faster resolution.
Receive Right to Sue Letter
If EEOC doesn't resolve your case, they'll issue a "right to sue" letter. You then have 90 days to file a lawsuit in court.
💡Pro Tips
- •Don't quit before filing (it may weaken your claim)
- •Consult an employment lawyer before settling
- •File timely - missing deadlines can bar your claim
